Terms of Service
The agreement for using Dayzy.
These terms explain the rules for using the Dayzy app, website, downloads, shared account services, subscriptions, uploads, product tools, and connected Dayzy experiences.
1. Agreement To These Terms
These Terms of Service explain the rules for using the Dayzy mobile app, Dayzy website, Android app downloads, account services, product dashboards, shared Dayzy tools, communications, and related features.
By creating an account, signing in, downloading the app, using the website, submitting content, starting a trial, making a purchase, or otherwise using Dayzy, you agree to these Terms.
If you use Dayzy for another person, family, business, school, organization, client, or event, you confirm that you have permission to use the service and accept these Terms for that use.
If you do not agree to these Terms, do not use Dayzy.
2. What Dayzy Provides
Dayzy is a connected product family for personal plans, people, memories, routines, events, reflection, and meaningful life details. Dayzy products may include Moments, Connect, Harmony, Spark, Reflection, Timeless, and other tools as they become available.
Some products, features, dashboards, trials, subscriptions, integrations, and account tools may be delivered through related Dayzy websites or product-specific experiences.
Dayzy is a growing service. Features may be added, changed, paused, renamed, limited, or removed over time.
3. Accounts And Eligibility
You are responsible for providing accurate account information, keeping it current, and safeguarding your login credentials.
You are responsible for activity that happens through your account unless the activity was caused by a security issue that was not your fault.
You must be at least 18 years old to create an account or use Dayzy features that include user-generated content, messaging, calls, invitations, or shared spaces.
Before using those features, you must confirm that you are 18 or older and accept the current Terms of Service and Community Guidelines. Dayzy records the policy version and acceptance time.
You may not access another person's account, private link, dashboard, guest area, upload area, or shared content without permission.
4. Shared Dayzy Account Access
Dayzy may use one account across multiple Dayzy products. Your account, subscription status, product access, support records, and limited profile information may be shared across Dayzy services so the product family works together.
Access to one Dayzy product does not guarantee access to every current or future product unless the plan, checkout page, subscription terms, or written agreement says so.
If a product is in preview, beta, limited release, or early access, it may work differently from a finished product and may change without notice.
5. App Downloads, Updates, And Device Use
The Dayzy website may provide Android app downloads. You are responsible for installing the app only from links you trust and for following device, operating system, and app store requirements that apply to your device.
The app may require updates for security, compatibility, or feature availability. Older app versions may stop working if they create security risk, are incompatible with the service, or can no longer be supported.
Dayzy is not responsible for device settings, operating system notices, network charges, unsupported devices, sideloading restrictions, or third-party platform decisions.
6. User Content
You keep ownership of the content you add to Dayzy, such as plans, memories, photos, event details, guest information, notes, reflections, messages, files, routines, and other materials you choose to save or share.
To operate Dayzy, you give Dayzy a non-exclusive, worldwide, royalty-free permission to host, store, copy, process, display, transmit, resize, format, and otherwise use your content as needed to provide, protect, maintain, troubleshoot, and improve the service.
You confirm that you have the rights and permissions needed to submit content to Dayzy and to allow Dayzy to process it for the service.
Deleting content from active product areas may not immediately remove it from backups, logs, emails, cached records, analytics, payment records, or other records Dayzy is allowed or required to keep.
7. Shared Pages, Guests, And Collaborators
Some Dayzy features may let you create pages, invite guests, collect responses, share links, upload media, or make information visible to family, friends, guests, collaborators, or the public.
You are responsible for the information you publish, invite, collect, or share. This includes names, photos, schedules, locations, contact details, school details, family details, and other personal information.
Do not share private, sensitive, or identifying information unless you have a valid reason and the rights or permission needed to share it.
8. Acceptable Use
You may not use Dayzy for illegal activity, harassment, threats, abuse, hateful conduct, impersonation, scams, spam, malware, phishing, deceptive pages, unauthorized promotions, privacy violations, or content that exploits or harms another person.
You may not try to interfere with the service, bypass security controls, scrape data, reverse engineer protected parts of the platform, overload systems, misuse invite links, or access data you are not allowed to access.
You may not use Dayzy for fraudulent payments, deceptive fundraising, money laundering, sanctions violations, unauthorized raffles, illegal lotteries, regulated financial activity, false emergency claims, or payment activity that violates law or payment provider rules.
Moments and Connect provide Report and Block controls. Reports may hide content while it is reviewed. Blocking prevents messages, calls, and invitations in both directions. Repeated or serious violations may result in a warning, content removal, suspension, or account termination.
You agree to follow the Dayzy Community Guidelines whenever you create, upload, share, message, call, invite, or interact with other people.
9. Subscriptions, Trials, Payments, And Cancellation
Some Dayzy features, plans, storage, products, templates, event tools, subscriptions, add-ons, or services may require payment. The checkout page, plan page, invoice, order form, billing portal, or separate written agreement controls the specific price, billing period, renewal terms, included features, and cancellation terms for that purchase.
New accounts may receive a trial or limited access period. A trial is not a free lifetime account or a promise of permanent access. Dayzy may limit, pause, or deactivate access if payment is not added, a trial ends, or a subscription is canceled.
Subscriptions may renew automatically through Stripe, WooCommerce, or another payment processor. If a plan renews automatically, you authorize recurring charges until the plan is canceled.
Plan changes may take effect immediately, at the next billing period, or according to payment processor rules shown at checkout or in the billing portal. Proration, credits, taxes, failed payments, grace periods, renewal dates, and payment collection may be handled by a third-party processor.
Unless a checkout page, written agreement signed by Dayzy, or applicable law says otherwise, fees are not refundable once paid.
10. Storage, Upload Limits, And Plan Limits
Plan descriptions may include storage, upload, media, guest, event, analytics, or support benefits. Unless Dayzy states otherwise in writing, storage and upload access are limited to the active plan and are not unlimited.
If your plan is downgraded, canceled, expires, fails payment, or loses access to a higher storage tier, the storage limit may decrease. If your account is over the active plan limit, Dayzy may block additional uploads until you reduce stored content below the limit or return to a plan that supports the usage.
Storage usage may be estimated from upload metadata, thumbnails, resized versions, original files, cached file data, and related media records. The displayed estimate may not match exact disk usage at every moment.
Dayzy may reject, resize, compress, archive, remove, or limit uploads that exceed limits, create technical risk, violate these Terms, or interfere with the service.
11. Third-Party Services
Dayzy may use or link to third-party services such as hosting providers, payment processors, app platforms, email tools, analytics providers, maps, social platforms, embedded media, fonts, or vendor websites.
Third-party services are controlled by their own terms and privacy practices. Dayzy is not responsible for third-party websites, services, errors, outages, fees, policies, provider decisions, or content.
Access to third-party services may change or stop if those providers change their services, terms, pricing, availability, risk rules, compliance requirements, or technical requirements.
12. Dayzy Materials And Intellectual Property
Dayzy owns or licenses the app, websites, dashboards, templates, layouts, designs, code, workflows, copy, graphics, branding, logos, and other materials we provide, excluding user content submitted through the service.
We give you a limited permission to use Dayzy and included materials through the service for their intended purpose. You may not copy, resell, redistribute, sublicense, reverse engineer, or use Dayzy materials to create a competing product without written permission from Dayzy.
Feedback, ideas, requests, or suggestions you send to Dayzy may be used without restriction or compensation, unless we agree otherwise in writing.
13. Copyright And Rights Concerns
If you believe content in Dayzy infringes your copyright, trademark, privacy, publicity, or other rights, email maven@mydayzy.com with enough detail for us to review the issue.
Include the link or product area involved, the content at issue, your contact information, and a clear explanation of your concern.
We may remove or disable access to content, contact the account owner, request more information, or take other action we believe is appropriate.
14. Privacy
The Dayzy Privacy Policy explains how Dayzy collects, uses, shares, and protects information. By using Dayzy, you acknowledge that information will be handled as described in the Privacy Policy.
Payment processors, app platforms, device providers, and other third-party services may collect and process information under their own terms and privacy policies.
15. Suspension And Termination
We may review, remove, restrict, suspend, disable, refuse, reverse, or terminate content, accounts, subscriptions, app access, shared pages, uploads, guest submissions, or features if we believe there is a violation of these Terms, applicable law, platform security, payment obligations, provider requirements, or the rights or safety of others.
We may take action without prior notice when needed to protect Dayzy, users, guests, vendors, payment processors, card networks, banks, or the public from suspected fraud, abuse, security risk, illegal activity, payment risk, chargebacks, disputes, sanctions risk, or other harm.
You may stop using Dayzy at any time. Some obligations in these Terms continue after account closure or service termination, including payment obligations, content permissions needed for prior service operation, ownership terms, disclaimers, limits of liability, indemnity, and dispute provisions.
16. No Professional Advice
Dayzy may help organize personal plans, memories, routines, relationships, events, legacy details, gifts, or life information. Dayzy is not legal, tax, financial, medical, therapy, safety, emergency, event planning, or professional advice.
You are responsible for decisions you make based on information stored in or generated through Dayzy. Consult qualified advisors where appropriate.
17. Availability And Disclaimers
Dayzy is provided on an as-is and as-available basis to the fullest extent permitted by law. We do not promise that the service will be uninterrupted, error-free, secure, compatible with every device, or suitable for every personal, family, business, legal, tax, financial, school, event, or health need.
Online services can experience maintenance, outages, data delays, third-party failures, bugs, or security events. You should keep your own copies of important information when needed.
18. Limitation Of Liability
To the fullest extent permitted by law, Dayzy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, event disruption, reputational harm, account restriction, third-party provider action, or the cost of substitute services.
To the fullest extent permitted by law, Dayzy's total liability for any claim related to Dayzy will be limited to the amount you paid directly to Dayzy for the applicable service during the 12 months before the claim, excluding pass-through amounts, taxes, payment processor fees, refunds, chargebacks, and third-party charges, or 100 dollars if you did not pay Dayzy directly during that period.
19. Indemnity
You agree to defend, indemnify, and hold Dayzy harmless from claims, losses, damages, liabilities, costs, fees, chargebacks, refunds, reversals, penalties, taxes, investigations, and expenses, including reasonable attorneys' fees, arising from your use of Dayzy, your content, your shared pages, your guest interactions, your purchases, your violation of these Terms, your violation of payment processor rules, or your violation of someone else's rights.
20. Governing Law And Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules, unless applicable consumer protection law requires otherwise.
Before filing a claim, you agree to contact Dayzy at maven@mydayzy.com so we can try to resolve the issue informally.
If a dispute cannot be resolved informally, it will be handled in the state or federal courts located in Texas unless applicable law requires a different forum.
21. Updates To These Terms
We may update these Terms as Dayzy changes, legal requirements evolve, or business practices are refined. The updated Terms will be posted on this page with a new effective date.
Your continued use of Dayzy after updated Terms are posted means you accept the updated Terms.
